By placing a reservation, submitting a rental request, making a payment, or using any rental equipment or vehicle provided by Out South Rentals ("Company," "we," "our," or "us"), you agree to these Terms of Service.

Submission of a rental request does not guarantee approval or availability.

All reservations are subject to:

• Vehicle or trailer availability
• Driver verification
• Insurance and eligibility requirements
• Approval by Out South Rentals

We reserve the right to decline any rental request for any lawful reason.

By submitting payment information, you authorize Out South Rentals and its payment processors to charge your payment method for:

• Rental fees
• Taxes
• Optional add-ons
• Security deposits
• Cleaning fees
• Refueling fees
• Tolls
• Damage charges
• Late return fees
• Any other authorized charges arising from the rental

You represent that you are authorized to use the payment method provided.

A refundable security deposit may be required before the start of a rental.

The deposit may be used toward:

• Damage claims
• Excessive cleaning
• Missing equipment
• Fuel shortages
• Smoking violations
• Unpaid tolls or tickets
• Late return fees
• Violations of these Terms

Any remaining balance will be refunded after inspection of the returned vehicle or equipment.

Cancellation policies may vary by rental type.

Unless otherwise stated:

• Cancellations more than 7 days before rental start receive a full refund.
• Cancellations within 7 days may be subject to partial or no refund.
• No-shows are generally non-refundable.

Out South Rentals reserves the right to issue refunds at its discretion.

Drivers must:

• Possess a valid driver's license
• Meet any age requirements stated during booking
• Provide accurate information
• Pass any required verification process

Providing false or misleading information may result in cancellation without refund.

Renters agree to:

• Operate vehicles safely and legally
• Follow all traffic laws
• Not use vehicles for racing, towing beyond rated capacity, off-road operation, illegal activities, or commercial transportation services
• Not permit unauthorized drivers
• Return rentals in substantially the same condition received

Additional rental-specific rules may apply and will be provided before rental commencement.

Renters are responsible for damage occurring during the rental period, unless otherwise covered by applicable insurance coverage.

The Company may charge the renter for:

• Physical damage
• Interior damage
• Tire or wheel damage
• Excessive wear
• Missing equipment
• Administrative costs associated with claims

Photographs, inspection reports, receipts, estimates, and repair invoices may be used to document losses.

Renters are solely responsible for:

• Parking tickets
• Speeding citations
• Toll charges
• Impound fees
• Traffic violations

Administrative processing fees may be added to these charges where permitted by law.

Late returns may result in additional charges.

If a renter fails to return a vehicle or trailer as agreed, Out South Rentals may take reasonable steps to recover the property and charge all associated costs.

A reasonable cleaning fee may be assessed if a rental is returned requiring cleaning beyond normal use.

Additional charges may apply for:

• Smoking
• Pet-related damage
• Excessive dirt or mud
• Stains
• Odors

Vehicles may utilize GPS, telematics, mileage tracking, charging records, or similar systems for operational, security, recovery, maintenance, or billing purposes.

By renting from Out South Rentals, you consent to such monitoring as permitted by law.

To the maximum extent permitted by law, Out South Rentals shall not be liable for:

• Indirect damages
• Lost profits
• Lost vacations
• Personal property left in a rental
• Delays caused by mechanical failures, weather, road conditions, or circumstances beyond our control

Our liability shall not exceed the amount paid for the rental.

Renters understand that operation of motor vehicles, trailers, and recreational equipment involves inherent risks.

Renters voluntarily assume all risks associated with use of rented property except where liability cannot legally be waived.

Before initiating a chargeback, customers agree to contact Out South Rentals to attempt good-faith resolution.

The Company may provide rental agreements, inspection reports, photographs, communications, GPS records, signed acknowledgments, and other relevant documentation in response to payment disputes.

Fraudulent chargebacks may result in collection efforts and recovery of associated costs where permitted by law.

We strive to ensure pricing and availability are accurate, but errors may occur.

Out South Rentals reserves the right to correct pricing, descriptions, availability, or other website information without notice.

These Terms shall be governed by the laws of the State of Utah without regard to conflict of law principles.

Any disputes shall be resolved in the appropriate courts located in Utah.
